Judge upholds cat custody ruling, saying parenthood and pet ownership aren't same

An Alberta Court of King's Bench ruled in December 2025 that four cats shared by former spouses Kishan Singh and Reba Smith would be divided equally, with each party receiving two pets. Justice Douglas Mah criticized attempts to apply a child's best‑interest standard to animals, arguing that pets are property whose care is judged by the owner's willingness and ability to provide adequate care. The case arose after Singh and Smith, who lived together for six years and separated in March 2023, fought over Salem (online ad), Diablo (SPCA), Zora and Samara (rescued strays). A November 2024 lower‑court trial had already awarded two cats to each, a decision the court now upholds. The ruling highlights Alberta’s distinction between child custody and pet ownership.
