Garnett also threw out the gun charge but kept stalking counts, which carry a potential life sentence, on the record. With a 30‑day window to appeal, prosecutors will now pursue the state case where Mangione faces nine counts, including second‑degree murder and weapons charges. The ruling is a setback for the Trump administration’s push for a death sentence. Jury selection in the federal case is set for 8 September.
