Former special counsel Jack Smith testified in a closed-door deposition to the House Judiciary Committee on December 17, 2025, defending his decision to prosecute Donald Trump in both the 2020 election interference and classified documents cases. Smith stated he had 'proof beyond reasonable doubt' for both charges and denied any political influence from President Joe Biden or Attorney General Merrick Garland. He argued Trump's actions 'to overturn the results of the 2020 election' were 'unprecedented' and 'no historical analog.' Smith said Trump 'obstructed' the classified documents investigation and 'caused and exploited' the January 6 Capitol attack. The deposition was limited to the election case after DOJ blocked Smith from discussing the documents investigation. Smith said he believed Trump would seek retribution against him for the prosecutions.
